The Consumer Disputes Redressal Commission in Kerala, India, has recently ruled in a consumer case regarding a Samsung Galaxy S23 Ultra that experienced overheating issues. The Commission determined that “Samsung India, e-commerce platform Flipkart, an official Samsung service center, and the retailer share joint liability for the consumer’s damages” and ordered them to “either repair the product free of charge or refund the purchase amount to the consumer.”

According to IndianExpress, an Indian District Consumer Disputes Redressal Commission issued this ruling against Samsung India, Flipkart, Samsung’s official service center “Bright Care,” and the retailer CIGFIL, regarding a Galaxy S23 Ultra that had suffered from overheating issues.

The court ordered either a free repair or a full refund of the purchase price of INR 100,000. The Commission also ordered the parties to pay INR 20,000 (~ $210) in compensation for mental agony and Rs 7,000 (~ $80) for litigation costs.

Galaxy S23 Ultra overheating issue

The buyer purchased the Galaxy S23 Ultra through Flipkart in January 2024. About two weeks after receiving the device, overheating and camera performance issues arose, prompting a visit to the service center.

The service center returned the device after performing a software update, stating, “A replacement is not possible without the manufacturer’s approval.”

The buyer subsequently requested a replacement from Flipkart as well, but when that request was also rejected, they filed a lawsuit with the Consumer Disputes Redressal Commission.

During the Commission’s hearings, Flipkart argued that it was merely an intermediary platform, while the service center claimed it had no authority to issue replacements.

Samsung India denied responsibility, raising the possibility that the device might have been a used product. The retailer also countered that manufacturing defects are the responsibility of the manufacturer.

Samsung Galaxy smartphone popularity is rising in South Korea, widening its lead over the Apple iPhone. A new survey reveals a significant surge in customer loyalty toward Galaxy devices, plus a decent retention rate.

According to Gallup survey, Samsung strengthened its position in South Korea’s smartphone market. Galaxy devices accounted for 81 percent, while 96 percent of existing Galaxy owners said they intend to buy another Galaxy.

Beyond attracting new users, the company appears to be keeping existing customers satisfied enough to stay within the Galaxy ecosystem.

The survey found that 81 percent of users aged 13 and above currently use a Samsung Galaxy device. That’s a nine percentage point increase from last year, making it one of Samsung’s strongest performances in recent years.

Meanwhile, Apple iPhone’s share slipped from 24 percent to 19 percent over the same period, allowing Samsung’s lead to expand from 48 percentage points to 62 percentage points.

On top of that, Samsung is also running special promo campaigns in the home ground to promote the latest devices. These are also contributing to this increased interest. Still, the price hike fear is real, and it’s showing effect among consumers.

DRAM crisis:

The semiconductor industry is cashing in on its resources during the generative AI era, and memory makers such as Samsung, SK Hynix and Micron have taken the central role in this price hike conversation.

These companies are putting more of their memory shipments to large AI firms, and reducing the DRAM production share for consumer devices. As a result, they not only created a supply issue but also increased the prices of the available memory chips.

Despite being part of the same group, Samsung’s mobile division isn’t getting any special offer on the memory prices. Therefore, it has to buy DRAM and NAND at the same prices as Apple and other memory makers.

It premieres Sunday at 7 PM on STN, the Samsung-exclusive channel baked into TV Plus, and it’ll keep airing weekly through mid-August. Samsung isn’t stopping there either, with Hero landing on Liberation Day, telling the story of independence fighter Ahn Jung-geun, and Crash Landing on You getting a Chuseok slot in late September.
